Final Order / Judgement

J U D G E M E N T

Bibekananda Pramanik, President: This consumer complaint under section 12 of the C.P. Act has been filed by the complainant Reba Samanto against the above named O.ps. alleging deficiency in service on their part.

Complainant’s case, in brief, is as follows:-

The Complainant invested a sum of Rs.1,30,000/- on 17.12.2015 in the scheme of “SAHARA Y-SELECT” of the O.p. for a period of 12 months vide No.705000642381 and membership no.15851502004 and a certificate was also issued to the complainant by the O.p. Date of maturity of the said certificate was on 17.12.2016 and the maturity amount was agreed to be paid at Rs.1,41,700/-. After completion of the maturity period, the O.p. did not pay the maturity amount to the complainant in spite of request by the complainant. Hence the ex-parte hearing.

Notice of this case was duly served upon the O.p. but the O.p. did not appear to contest this case for which the case was ordered to be heard ex-parte.

POINT FOR DECISION

          Whether the complainant has been able to prove the case against the O.p. and whether he is entitled to get the reliefs, as prayed for?

DECISION WITH REASONS

To prove his case, the complainant has tendered a written examination-in-chief supported by affidavit and he has also filed the photocopy of said policy certificate.

In his evidence, the complainant has fully corroborated his case of the petition of complaint and the copy of investment certificate also lend support to the case of the complainant.

So, in view of the said un-challenged evidence of the complainant, it is held that the complainant has been able to prove his case and he is entitled to the reliefs as prayed for.

Hence, it is,

           O  R   D    E    R    E    D       

          that the complaint case no.25 of 2018 is allowed ex-parte with cost against the O.p.

          O.p. is directed to pay the maturity amount of Rs.1,41,700/- to the complainant alongwith interest  @ 8% per annum with effect from the date of maturity on 17.12.2016 till realization. O.p. is further directed to pay Rs.20,000/- as compensation and Rs.5,000/- as litigation cost to the complainant.

          As such payments shall be made within 2 months from this date of order.

          Let plain copy of this order be given to the complainant free of cost.
