            The case of complainant is that the complainant purchased a gold chain of 89.120 gms. worth Rs.1,64,845.26 on 21/8/10 as per the invoice No.14009 from the respondents jewellery.  At time of purchase the respondents represented that the gold chain is tested by BIS  and the  symbol of Hall Mark is sealed on the gold chain.  But later on verification there was no such hall mark.  This act of respondents is unfair trade practice.  So the complainant was caused o send a lawyer notice and the averments in the reply notice are incorrect.  Hence the complaint.

          2. The respondents are remained exparte.

          3. The complainant filed affidavit and Exhibits P1 to P5 documents to prove his case.

          4. The complainant alleges that the gold chain purchased from respondents jewellery lacks BIS hall mark.  It is the case that at the time of purchase the respondents  falsely represented that the chain is BIS hall marked.  This complaint is filed to get  replacement of another gold chain in the same model and weight.  Since there is no evidence to the contrary the complaint is liable to be  allowed.

 

          5. In the result the complaint is partly allowed and the respondents are directed to provide a BIS hall marked gold chain to complainant of the same quality, model and weight with costs Rs.1,000/- within two months from the date of receipt of copy of this order.
