The case record is taken up for order in regard to the petition dated 23/04/2009 filed by the complainant seeking for withdrawal of the instant case against the OP(s) (the Manager, Speed Post, Siliguri Division & the Post Master General).

 On the last occasion no quorum was constituted in the Forum as a result with regard to the petition filed by the complainant no any order could be passed.  In the petition dated 23/04/09 the complainant has virtually prayed for withdrawal of the case as because the matter has already been settled out of court in between the parties. 

 On the other hand the OPs have filed a letter issued by the complainant to the OP No.1 in which it has stated that the complainant has received payment of Rs.738/- (Rupees seven  hundred thirty eight) only on 20/04/2009 from Siliguri Head Post Office.  It has further stated that the complainant has no claim or demand pertaining to the instant case and the letter be treated as withdrawal petition.

 In the above juncture we have no other option except to disposes off the case in view of the petition filed by the complainant.  Hence,

 It is,

           O R D E R E D 

that the Consumer Case No.09/S/2009 be and the same is hereby disposed off on compromise between the parties.  Thus the case is disposed off.  No order as to cost.
