       That the complainant’s brother  Baiju who is  working in Indian Air Force at Agra sent a Motor cycle on 24/7/14 to the complainant through Indian Railway Parcel service and he has to collect the said Motor cycle  from  Central  Railway Parcel Office Mangalore and the said vehicle was  reached to the Central  Railway Parcel Office Mangalore on 27/7/14.  The complainant’s brother sent the Key, RC and Delivery slip in respect to the vehicle through the opposite parties on 24/7/2014.  The complainant has to take delivery of the above said articles from the 2nd opposite party’s office at Kasaragod and  to approach the Central  Railway Parcel service Mangalore for delivering the vehicle.  As per the Railway Rules  the complainant has to take delivery of the vehicle on 28/7/14  before 3.p.m, otherwise , he has to pay a penalty of Rs.11/- per hour until delivery of the vehicle.  But the complainant could not get the above said key RC book and delivery slip on 28/7/14 and he could not take delivery of the vehicle.  Then he enquired the matter to the opposite party and he came to know that the above  items reached to opposite party’s office at Kozhikode instead of Kasaragod when the complainant enquired about the delay from the opposite parties they insulted him.  Then the complainant collected the articles from the Kannur office of opposite party on 14/8/2014 and thereafter he had taken delivery of the vehicle by paying  penalty of Rs.1690.  Hence this complaint is filed against the opposite parties alleging deficiency in service.

 Opposite parties  duly served the notice issued b y this forum but not turned up.  Name of opposite parties called  absent and set exparte.

   The complainant is examined as PW1 and Exts.A1 to A3 were marked.  Heard the complaint.

   Ext.A1 is the  acknowledgment  issued by Ist opposite party . Ext.A2 is the receipt of payment of penalty and Ext.A3 is the  Delivery slip issued by Railway.

  Here the opposite party  eventhough  duly served the notice, failed to appear before the Forum.  No contra evidence on the part of opposite party.

   On going through the entire facts of the case and perusal of records it is evident that the opposite parties failed to provide proper services to customers and thereby the complainant had suffered mentally  and economically.

  Therefore the complaint is allowed directing the opposite parties jointly and severally to pay Rs. 1690/- to the complainant towards the penalty amount paid by him and also directed to pay Rs.5000/- as compensation and Rs. 2000/- towards cost of the proceedings.  Time for compliance is 30 days from the date of receipt of copy of this order.
