By G. Yadunadhan, President: The case of the complainant is that complainant had availed a loan for purchasing a Bajaj CT100 Motorcycle from the opposite party. The above said loan was cleared on 23.7.2005. After settling the loan complainant demanded to release No Objection Certificate along with duplicate key. After repeated demands, opposite party refused to do so. Hence complainant seeking relief against the opposite party to pay a compensation of Rs.1,00,000/- along with cost of this proceedings. After serving notice opposite party appeared and filed version denying the allegations made by the complainant. When the case was specifically posted for evidence on 3.3.2009, opposite party called absent and set exparte. Complainant was examined as PW1 and Ext. A1 to A4 were marked. From the evidence of the complainant and from the Ext. A1 to A4, complainant’s case is proved. In the result petition is allowed and the opposite party is directed to hand over the duplicate key of the alleged vehicle along with No Objection Certificate and also pay a compensation of Rs.3000/- to the complainant. No order as to cost. Comply the order within 30 days on receipt of the copy of this order. Pronounced in open Court this the 20th day of March 2009.
