| Final Order / Judgement | Complainant is absent without taking any step. O.P. No. 1, 2, 3 (a) & 3 (b) and O.P. No. 4 are present through their Ld. Advocate. Today is fixed for filing show-cause by the Complainant i/d necessary order will be passed. Ld. Advocate for the Complainant verbally submits that she has not received any instruction from the complainant. It is from the case record that on dt. 26.11.2022 this case is transferred to the Upbhokta Lok Adalat for settlement. On that day both parties are present but Lok Adalat Bench initiative fails. After that two separate dates are allotted Order No. 48 dt. 28.11.2022 and Order No. 49 dt. 02.01.2023 for taking steps by the complainant. On dt. 03.02.2023 Order No. 50 the Complainant files hazirah. No steps were taken by the Complainant. The case is fixed for filing Evidence-on-affidavit by all the parties. On dt. 20.03.2023 Order No. 52 O.P. No. 1, 2 3(a) & 3 (b) and O.P. No. 4 files Evidence-on-affidavit. Copy served to the Complainant. After that several opportunities were given to the Complainant for filing Evidence-on-affidavit. During this period the Complainant neither takes any steps nor files Evidence-on-affidavit. On dt. 21.06.2023Order No. 55 this Commission directed to the Complainant to file show-cause. There after, two separate dates 07.07.2023 and 14.07.2023 are allotted to the Complainant for filing show-cause as to why the case shall not be dismissed. Today neither the Complainant nor the Ld. Advocate engaged by the Complainant files hazirah, it is time now 1.15 p.m. this Commission has no other alternative accept to hold that the Complainant is not further willing to proceed with the case. Hence, It is O R D E R E D The case CC/23/2019 is dismissed for non prosecution by the complainant. Let a copy of this order be given to the Complainant and other O.P’s free of cost. | |
