ORDER

Order dt.29/04/1991 The complaint is allowed. The Impugned actio;n of the OP Bank in adjusting a sum of Rs.18,583-80 o;ut of the Fixed Deposit of Rs.26000/- standing in the name of the complainant, towards the satisfaction of the loan advanced to Mr.B.S.Babu, is hereby set aside. The OP bank is directed to proceed against the Autorickshaw Bearing Registration No.MYZ 6958, standing in the name of the said Mr.B.S.Babu who has hypothicated the same towards the loan advanced to him and recover the outstanding dues by seizure and sale of the said vehicle. In case if the entire loan with interest is not recovered by the seizure th same of the said vehicle, it is at liberty to proceed against the complainant who is only a surety. It shall restore the fixed deposit standing in the name of the complainant with interest upto date as stipulated and pay a compensation of rS.500/- to him alongwith a cost of Rs.100/-.
