                                                            JUDGMENT

1.                     The facts of the complaint  in brief is that  the   complainant  has purchased a Maggi Noodle packet from the O.P No.1 and after days of purchasing he came to know from the T.V  news that  the Maggi Noodle has been banned by the State Government and Central Government and after knowing the fact the complainant approached the O.p 1 to take return of the same  but the O.p 1 refused  to take back and directed to ask O.p No.2. The complainant approached the O.p 2 but no fruitful result. The O.P No.1 refused to give bill. Hence prayed to direct direct the O.ps to refund the cost of the Noodles  and award compensation of mental agony of Rs.1,00,000/- and  litigation charges. Hence , this complaint.

                         On being noticed, the O.ps neither   appeared nor  filed written version as such they were set exparte and in absence of any written version from the opposite party we proceeded  the matter exparte and  believed  the allegations of the complainant  and  hence, we passed the order and  disposed of the matter with the following directions.

 

                                                                       ORDER

                        The  opposite party  is  directed to refund the cost of the Noodles and pay compensation of Rs.1,000/-    for mental agony  and harassment undergone  by the complainant  within one month from the date of receipt of this order, failing which the O.P is  liable to pay  interest  @  12%  p.a. on the above awarded amount till  the date of payment.

                        Pronounced in open forum today on this 5th day of December,2015 under the seal and signature of this forum.

                         A copy of this order as per the statutory requirements , be forwarded to the parties    free of charge.
