The complainant side is present today . We have heard submission of the ld advocate Ms Aparijita Rana for the complainant . It is seen that the complainant ordered for supply of 120 drums of Bitumin to the opposite party , but  found 30 drums of Bitumin short supplied  by the opposite party for which he was unable to complete his end of the deal in the road construction project .  The complainant , it is seen  , ordered  the Bitumin for commercial purpose. As defined for a consumer under Sec-2(d)(i)and (ii) of the Consumer Protection Act ,1986 the complainant is not a consumer .  Hence , the complaint filed by Mr Lamzolian  Vaiphei is not admitted & rejected  for drawal of a proceeding under the Consumer Protection Act, 1986. However , the complainant is at liberty  to file his complaint at other appropriate forum.
