Sri. CK, Advocate for the Complainant and the accused are present.  Sri. CS files power for the accused and also Application for the advancement.  Hence, by consent of both the parties, the case is advanced to today.  By consent of both the parties, Plea of the accused is recorded.  His plea of guilty is accepted.

It is seen that in CC No. 03/2010 an order was passed by this Forum on 19.05.2011.  In spite of that and in spite of this Execution Application 30/2011, accused engaging an Advocate, had failed & omitted to comply with the Order.  Now, accused has tendered DD No. 041761 dtd. 10.05.2012 for Rs.2,25,000/-, the same may be kept in deposit in the name of the Forum. 

It is further seen that accused has preferred Appeal No. 586/2012 before the Hon’ble State Commission and it is posted on 10.07.2012.  There is o stay order.  However, this amount be kept in deposit till disposal of the Appeal before the Hon’b le State Commission.  After disposal of the Appeal, the amount be paid to the successful party.  Hence, we pass the following order:

ORDER

Accused is convicted for the offence punishable u/s. 27 of the C.P. Act and sentenced to pay fine of Rs.2,000/-, in  default, to undergo simple imprisonment for 3 months.

NBW is recalled.  The amount in deposit be deposited in the name of the Forum until disposal of the Appeal.
