Smt. K.G.SHANTALA, Member. --- Consumer Complaint No. 37/2009 Between: 1. Y.S. Suhas (Minor) S/o. Y.N. Suresh Babu, Aged about 12 Years. 2. Y.S. Sneha (Minor) S/o. Y.N. Suresh Babu, Aged about 09 Years. 1 and 2 represented by Guardian, Y.N. Suresh Babu, Both are residing at Sadashiva Badavene, C.B. Pura Road, Gowribidhanur. 3. R.G. Shobha, W/o. Y.N. Suresh Babu, Sadashiva Badavene, C.B. Pura Road, Gowribidhanur. V/S 1. The Manager, The K.D.C.C Bank Limited, Gowribidhanur Branch, Gowribidhanur. .Complainants 2. Kolar. .Opposite Parties ORDERS This is a complaint filed under section 12 of the Consumer Protection Act, 1986 praying for a direction against the opposite parties to pay the matured fixed deposits to complainants with costs, interest, etc. 2. The complainants No.1 to 3 deposited with OP.1, Rs.45,000/- each on 26.09.2001 repayable after 72 months with interest at 12% p.a. After maturity period the amount payable in respect of each F.D. was Rs.91,476/-. It is alleged that OP.1 failed to repay the matured deposits. 3. One Sri. Venkatareddy, Office Superintendent of OP.1 appeared in response to notice and prayed time to file version. OP.2 did not appear before us. Subsequently OP.1 also remained absent. Y.N. Suresh Babu the father of complainant No.1 and 2 and husband of complainant No.3 has filed the affidavit in support of the allegations made in the complaint. He also filed Xerox copies of the F.D. receipts issued by OP.1. 4. We perused the records. We are satisfied regarding the truth of the claim made by complainants. In similar cases against OP.1 and other branches of K.D.C.C. Bank, the subsequent interest was allowed at 8% p.a. on the matured amount from the date of its maturity. The same rate of interest may be awarded in this case also. 5. Hence we pass the following: O R D E R The complaint is allowed with costs of Rs.1,000/- against OP.1. OP.1 shall pay Rs.91,476/- (Rupees Ninenty One Thousand and Four Hundred Seventy-Six only) to each of the complainants No.1 to 3 with interest at the rate of 8% p.a. on the said amount from 26.09.2007 till the date of payment, within 30 days from the date of this order.
