The complaint is filed against the opposite party to rectify the defects of a Mixy.

2. The complaint is filed on 07.06.2012, Notice were sent to opposite party on 14.06.2012, but notice of opposite party is returned stating that “ Not Known”.

Thereafter the case is posted to take steps against the opposite party, but in so many occasions the complainant not present before the Forum and not taken any steps or not intimated the status of the complaint. At last the Forum sent Registered Notice to the complainant on 06.05.2013 and 22.11.2013 and served on 10.05.2013 and 25.11.2013 respectively, but even today the complainant not appeared before the Forum and no steps has been taken or not intimated the status of the complaint before the Forum. Hence we find that continuous absence of complainant is nothing but an abuse of the process of law. Hence it is a fit case to impose penalty under section 26 of the Consumer Protection Act 1986.

In the result the complaint is dismissed for default and directing the complainant to deposit Rs.500/- (Rupees Five Hundred) only as fine before the Wayanad Consumer Disputes Redressal Forum within on month from the date of receipt of this Order.
