On perusal of record, it is found that, Complainant was absent on dt. 07-02-2023, 20-02-2023, 13-03-2023, 03-04-2023 and on 27-04-2023.
To-day also on repeated calls, Complainant is absent.
The Complainant has claimed Rs.40,00,000/- towards the cost of two vehicle, Rs.5,00,000/- towards loss sustained by the Complainant, Rs, 5,00,000/- towards harassment and mental agony suffered by the Complainant and Rs.1,00,000/- towards cost of litigation and total Rs.51,00,000/- has been claimed by the Complainant in the complaint petition. In the present case the consideration amount paid by Complainant is less than Rs. 50 lakhs, as such the State Commission has no pecuniary jurisdiction to entertain this Complaint petition.
Hence the Complaint petition is dismissed as the same is not maintainable before the State Commission.
