This Execution Application has been arisen out CC/09/2013 which was disposed of on 17.01.2014 being allowed on contest against the Opposite Party with a cost of Rs.2,000/-. The Opposite Party is directed to pay a sum of Rs.(2,00,000.00–16089.18)= Rs.183,910.82 to the complainant as benefit of the Insurance Policy within 45 days here from. If the Opposite Party fails to comply with the order of the Forum, he is to pay Rs.50/- as fine per day’s delay and the amount to be accumulated shall be deposited in the State Consume Welfare Fund.
The D.hr has filed this Execution Application on 28.03.2014 as the Jdr.-OP did not comply the aforesaid order.
The case has been fixed for awaiting order from the Hon’ble State Consumer Disputes Redressal Commission, W.B. vide FA No. 380 of 2014 for numerous dates. The D.hr. is found absent since 30.10.2014. The Jdr has been filing only haziras.
Now the order of the Hon’ble State Consumer Disputes Redressal Commission, W.B. dated 30.10.2014 has been derived from ‘CONFONET’ in Appeal No. FA No. 380 of 2014.
The Hon’ble State Consumer Disputes Redressal Commission, W.B. has passed the order in that appeal on 30.10.2014 as under:-
‘That the appeal be and the same is allowed on contest against the Respondent, but without cost. The impugned order is hereby set aside. Consequently, the complaint case stands dismissed.’
As per above order of the Hon’ble State Consumer Disputes Redressal Commission, W.B., the complaint is dismissed and as such the execution case be disposed of accordingly.

that the Execution Application No. 10/2014 be and the same is hereby disposed of as per order dated 30.10.14 of the of the State Consumer Disputes Redressal Commission, W.B.
Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld.
