         Today is fixed for filing evidence by the Complainant as another special chance. The record shows that the Complainant was found absent on call on 21.07.20, 16.09.20, 30.12.20, 17.03.21, 23.04.21, 16.06.21, 18.11.21, 07.03.22, 01.06.22, 20.12.22, 30.03.23, 14.06.23, 23.08.23, 09.11.23 and today i.e. on 20.02.24.

          The Complainant Jobi Shekh @ Sekh filed the instant case praying for necessary direction to the OPs to pay insured declared value of the vehicle i.e. Rs. 17,22,000/- along with the interest till realisation.

          But the Complainant has not been filing evidence for long period. The Complainant has also been being absent for long period. Such being the position, we are of the view that the instant case has no merit and as such the Complainant is not at all interested in the instant case.

          The instant case is liable to be dismissed.

Hence, it is

                                               Ordered

that the complaint Case No. CC/85/19 be and the same is dismissed on merit against the OPs.

          Let plain copy of this order  be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand  /by post under proper acknowledgment  as per rules, for information and necessary action.
