Shankar Bhat, 72, Laxmi Sadan, 13th Cross, II Main, Vittal Nagar, Bangalore-560 026. Complainant V/S The Manager, State Bank of Travancore, Banashankari Branch, Girinagar, Bangalore-560 085. Opposite Party ORDER By the President Sri. S.S. Nagarale This is a complaint filed by the complainant stating that the complainant has got joint S.B A/c with the opposite party Bank for 15 years. The complainant deposited a D.D for Rs.49,261/- on 31/3/2008 with the opposite party Bank. D.D was sent to Puttur Branch, but so far amount has not been credited to the S.B A/c of the complainant. Therefore, the complainant requested to take immediate action in the matter and prayed for grant of compensation on account of financial loss and mental agony. 2. Notice was issued to opposite party. The representative of the opposite party appeared in person on 26/6/2008 and filed version stating that the instrument was sent for collection through courier to SBI, Puttur. On enquiry it came to notice that the instrument (D.D) was wrongly delivered to Puttur, Andrapradesh and the said branch was requested to return the instrument. They had sent the instrument directly by registered post to SBI, Puttur(Karnataka) on 13/5/2008 and opposite party Bank received the proceeds of the D.D on 17/5/2008 for Rs. 49,261/- and on 20/5/2008 amount was credited to the S.B account. Delay was caused by the wrong delivery of letter by M/s Speed and Safe to wrong branch. Opposite party Bank credited OD interest of Rs.270/- to the S.B account. 3. Arguments are heard. REASONS 4. The complainant admitted that the proceeds of D.D was credited to his account, but he submitted that there was delay of 50 days in crediting the amount. Therefore, there is deficiency in service on the part of the opposite party Bank. No doubt the opposite party Bank has credited OD interest of Rs.270/- to the account of the complainant for delayed collection and credit. The complainant is a customer of opposite party Bank for last 15 years. Opposite party Bank should serve the customers in more careful and prompt manner. The protection of the consumers is the need of the hour. The C.P Act is enacted to safeguard the better interest of the consumers. This is an age of science and technology. On account of revolution in computer technology it will not take more than one day to credit the D.D proceeds to the S.B account of the customers. D.D was sent to S.BI, Puttur, Andrapradesh instead of same to SBI, Puttur, Karnataka. This is nothing but negligence or carelessness on the part of the opposite party Bank. For this negligence the complainant cannot be asked to suffer or wait for such a long period to get the amount. Every Bank display in the Bank premises the famous statement of M.K. Gandhi, the father of nation. The statement of M.K. Gandhi is as under:- “A Consumer is the most important visitor in our premises. He is not dependent on us. We are dependent on him. He is not an interruption in our work. He is the purpose of it. He is not an outsider on our business. He is a part of it. We are not doing him a favour by serving him. He is doing us a favour by giving us an opportunity to do so.” But in this case, the opposite party Bank has taken 50 days time in crediting the DD proceeds to the account of the complainant. This is a very unreasonable delay. No doubt the Bank had credited OD interest of Rs.270/- to the S.B account of the complainant. To this the complainant is not satisfied and he argued suitable compensation be awarded to him on account of deficiency of service. The complainant has to wait for 50 days to get the amount. This waiting period is really horrifying and it really a period of tension and mental agony and also the complainant might have put into inconvenience and hardship. For these reasons it is just and proper to award Rs.1,000/- as compensation to the complainant for deficiency in service on the part of the opposite party Bank. In the result, I proceed to pass the following:- ORDER 5. The complaint is allowed. The opposite party Bank is directed to pay Rs.1,000/- as compensation to the complainant. The complainant is also entitled to Rs.500/- towards costs of the present proceedings from the opposite party. The opposite party Bank is directed to comply the order within 30 days from the date of this order. The amount be sent or credited to the account of the complainant with intimation to this Forum. 6. Send the copy of this Order to both the parties free of costs immediately. 7. Pronounced in the Open Forum on this 30TH DAY OF JUNE 2008. Order accordingly, PRESIDENT We concur the above findings.
