Final Order / Judgement

Case called.  This complaint filed by the complainant on 08.12.2020 though his advocate.  This matter was taken up for admission hearing on 16.12.2020.  On that day, the complainant and his counsel were absent. Then this matter is posted on 20.12.2020.  On that also, complainant and his counsel called out absent.  Hence, this case is posted for hear on the admissibility of the case on this day.  Today, the complainant and his counsel called out absent.  Hence, this Commission has no other go to pass the necessary orders.

This instant complaint is filed against the OP to direct to remove the Negative Cibil rating which has been made without any reasonable cause.  Hence, remove the said stigma as the same has been passed on the fake loan account created by the OP Bank.  The plain reading of the para No.10 of the complaint, the complainant has made certain allegations as against the OP in respect of creating the fake loan account created by it and attached its stigma on complainant as negative cibil rating.  When the entire case of the complainant is based on creating the fake loan account by the OP which needs full pledged trail by adducing the cogent evidence, but it cannot be in the summary trial being adopted by this Commission.  Hence, complaint filed by the complainant is dismissed.  The complainant is directed to approach competent authority to get his redress and dispose of by taking assistance of Laxmi Engineering works v. PSG Industrial Institute, II (1995) CPJ 1 (SC) on the question of limitation
