This case coming on this day for final hearing before us in the presence of Sri M.Manohar Naidu, Advocate for the complainant and Sri L.K.Sudheendranath, Advocate for the opposite parties 1 to 3 and 5 and the 4th opposite party is called absent and set-exparte and after perusing the material papers on record and after hearing the arguments on both sides, the Forum delivered the following:
DOCKET ORDER
Memo field by both parties stating that the above case is settled with the following terms and conditions.
1. The case is settled between both parties for an amount of Rs.1,73,000/- and the said amount was received by the opposite parties on 05.10.2014.
2. The opposite parties agreed that not to collect penal interest, not to collect any Cheque dishonor amount and any legal charges etc. from complainant with regard to this loan amount till to day i.e., o5.10.2014.
3. The complainant is agreed to pay the future installments from today onwards regularly as per terms and conditions.
4. The opposite parties agreed to return remaining cheques of complainant and Sobha Devi (including dishonor cheques) to the complainant and obtained receipt for the same.
5. The complainant is agreed to keep 10 cheques of complainant in the custody of opposite party for due period of 10 installments and remaining cheques to be returned to the complainant and obtained receipt for the same. Because of non-availability of cheques at opposite party and issued under taking dt.05.10.2014 stating that brought from CMS Kurnool and handed over to Bhaskar Reddy.
Hence the above terms recorded. In view of the above as the matter is settled between both parties the complaint is dismissed.
