No step is taken by the O.P. who is found absent on repeated call.

The case is fixed for argument.

Hearing argument from the complainant side the Commission proceeds to dispose of the case as hereunder.

Complainant case is that he stored 142.50 Quintals Jyoti potato with O.P. Cold Storage under the bonds dated:15-03-2017 & 16-03-2017 out of which 19.50 Quintal was delivered to the complainant within the scheduled time but remaining stored potatoes weighing 123 Qtl. was not returned to the complainant within the stipulated time. The complainant approached this Commission with the allegation of deficiency in service on the part of the O.P. claiming Rs.61,500/- with interest as the price of undelivered potatoes (@ 500/- per Qtl) together with compensation of Rs.20,000/-

The O.P. submitted his written version in the form of letter under letter head dated:15-06-2019 admitting the fact of delivery of 19.50 Qtl. Of potato but denying is default for non-delivery of rest 123 Qtl. Potato within the stipulated time frame as no approach was made from the complainant for return of the same.

At the time of hearing the complainant referred to the potato bonds and other materials on record and prayed for the above relief. None was present on behalf of the O.P. to establish the defence case. As per terms and conditions of the potato bonds it is the duty of the O.P. to sell the undelivered potatoes in public auction and disburse the sell proceeds to the bond holder but the O.P. has not fulfilled the terms and conditions of the bond and violated the relevant laws and thereby he has committed deficiency in service by non-delivery of remaining stored potatoes weighing 123 Qtls. and not disbursing the sell proceeds thereof to the complainant. The complainant has proved his case and he is entitled to get the relief as prayed for.

Hence it is ordered……. 

That the case be and the same is decreed ex-parte against the O.P.

The O.P. is directed to pay to the complainant Rs.61,500/- together with Rs.10,000/- as compensation within one month from this date failing which the decretal amount maya be recovered in due process of law.
