The complainant is before this forum by filing a complaint u/s 12 of the Consumer Protection Act,1986, alleging deficiency of service in the part of the O.P. .
2. His allegation in the complaint is that, he is a private employee and operates an account vide No.64056610776 with the O.P. Bank. On 10.03.2017, he used his A.T.M. Card issued by the O.P. and drew a sum of Rs.10,000/-. On the same day he once again tried to withdraw another sum of Rs.10,000/- but didn’t succeed in his attempt. Inspite of that, the Bank has debited the amount to his account. Later, he confronted the Bank authorities, who verified the C.C.T.V. image and confirmed that, in respect of the second transaction on 10.03.2017, the same was not done and promised to make good the wrongful debit for which he approached this forum seeking 12% p.a. on the wrongly debited amount, the amount itself together with compensation of Rs.10,000/- and litigation expenses of Rs.5,000/-.
3. The O.P. Bank, putting up appearance through counsel on 22.09.2017 has deposited Bankers’ cheque of Rs.10,000/- favoring this forum and the same was submitted for encashment on 25.09.2007.
4. In the absence of any dispute, we feel there is no necessity to fix or answer any points and hence we proceed to pass the following:-
::ORDER::
- The complaint is allowed in part.
- The O.P.s is directed to pay interest @ 6% p.a. on the wrongly debited sum to be calculated from 10.03.2017 till 22.09.2017 ( The date of return of the amount).
- The O.P. is also directed to pay a sum of Rs.1,000/- (one thousand) as compensation and a further sum of Rs.1,000/- (one thousand) towards the litigation expenses;
- The complainant would be at liberty to withdraw the amount deposited by observing due process of law;
- Four weeks time granted to comply the order at (a) and (b) above.
