Versus.

JUDGEMENT.
The crux of the case is that the above named complainant alleging deficiency in service against afore mentioned O.Ps for non refund of advance amount a sum of Rs.25,500/- for which the complainant sought for redressal of the grievances raised by the complainant.
On being noticed the O.Ps neither entering in to appear before the District Commission nor filed their written version inspite of more than 5 adjournments has been given to them. Complainant consequently filed his memo and prayer to set exparte of the O.Ps. Observing lapses of around 7 (Seven) months for which the objectives of the legislature of the C.P. Act going to be destroyed to the prejudice of the interest of the complainant. Hence after hearing from the complainant set the case exparte against the O.Ps. The action of the O.Ps are against the principles of natural justice as envisaged in C.P. Act. Hence the O.Ps. were set exparte as the statutory period for filing of written version was over to close the case with in the time frame permitted by the C.P. Act.
From this it is evident that the O.P. has failed to fulfil his commitment to the complainant. This amounts to breach of agreement on his part, where as the complainant on his part has discharged his duty by transmitted an amount of total Rs.25,500/- to the bank account of the O.P on Dt. 24.7.2020 bearing Google transaction ID CICAgKDZu- HIMw for beginning seeds purchase and sale business at Rayagada area of Odisha for livelihood of the complainant.
It is held and reported in C.P.R.-1993 (1) page No. 420 The Hon’ble West Bengal State C.D.R. Commission, where in observed “When one not perform his part of contract it amounts to deficiency in service.”. In the light of this ruling we hold that the O.P. has not performed his part of the contract by not sending the seeds or appointment of dealership to the complainant after receipt of the consideration from the complainant.
To meet the ends of justice the following order is passed.
ORDER.
The O.P. is directed to refund the deposited amount a sum of Rs.25,500/- to the complainant immediately along with up to date interest @ Rs. 9% per annum from the date of deposit till realization.
The O.Ps are directed to pay the aforesaid amount to the complainants with in 30 days.
