Case of petitioner filed on 14..6..2011 is as follows.
Petitioner insured his goods vehicle, with 2nd opposite party for a period from 4..8..2009 to 3..8..2010. During policy period on 7..8..2009 vehicle met with an accident. petitioner preferred an own damage claim for Rs. 129761/-. Opposite party so far not processed the claim. Hence this petition.
Opposite party filed version stating that on report of claim authorized surveyor assessed damage and filed his report. As per his report company is liability to indemnify for Rs. 82,106.82 . Since petitioner had not submitted

sighned claim form claim is not processed. In the version they submitted that they are ready to process the claim.
We heard both sides, In our view. On the basis of admission of opposite party we allow the petition.
In the result petitioner is directed to forward a sighned claim form as insisted by opposite party in accordance with law. Opposite party is directed to process the claim at the earliest and give the petitioner Rs. 82,106.82, amount assessed by the surveyor. Considering fact and circumstances of the case no cost and compensation is ordered. Order shall be complied with within one month of receipt of a copy of the order. If not complied as directed award amount will carry 9% interest from the date of accident till realization. Petition disposed accordingly.
