ORDER

            In compliance with the notice/order dated 15.05.2020 & 29.05.2020 of the Hon’ble State Commission, U.T. Chandigarh, case taken up through video conferencing due to outbreak of COVID-19 & measures to control it, as per Standard Operating Procedure framed by the Hon’ble State Commission, U.T. Chandigarh.

            Per office report, the Complainant was informed telephonically. However, the Complainant has not put in appearance, despite knowledge, through virtual hearing.

            Perusal of the record shows that this case was fixed on 09.12.2020. Even on the said date, none had put in appearance for the Complainant. However, an application was received from the Complainant through e-mail, wherein permission was sought to withdraw the Consumer Complaint, as the matter stood compromised. Along with the said application, a Settlement Deed dated 01.10.2020 has also been annexed. The said e-mail was received from the e-mail account of the Complainant i.e. prabirdaspgi@gmail.com.

            In view of receipt of the aforesaid application, through e-mail, for withdrawal of the Complaint, accompanied with copy of Settlement Deed and non-appearance of the Complainant, despite knowledge, even on the previous date i.e. 09.12.2020 and even today the Complainant has not put in appearance despite having been informed telephonically, it goes to suggest that the Complainant is not interested in the further prosecution of the Consumer Complaint. Hence, this Consumer Complaint is dismissed for want of prosecution and per the observations made hereinbefore, the Award is accordingly passed.

            Certified copy of this order be communicated to the parties free of charge.  After compliance file be consigned.
