The complainant is present. Today is fixed for filing amended complaint by the complainant. But today the complainant has filed a petition supported by affidavit praying for permission to withdraw the instant complaint with liberty to file afresh.
Upon careful consideration of the said petition, in our view that as the complainant is not inclined to proceed with the instant complaint further and files an application in that contest, hence the complaint is dismissed.
It is Ordered,
that the C.C. No. 735/2016 is hereby dismissed due to non prosecution. However, the complaint is at liberty to file afresh within 30 days from the date of passing of this order, if necessary.
Let a plain copy be supplied to the parties free of cost.
