            Complainant files hazira. Today is fixed for hearing of this case.

            Hd. and pearused the record, it appears that the Op was given ample opportunity if filing W.O. fixing this date. But no step has been taken for hearing. Order No.7 is pointed out by the Ld. Advocate whereby the Op. was charged with a cost of Rs.500/-(Five hundred) only but subsequently on any occasion the cost was not paid. In that event prayer for vacating the                  ex-parte order should not come into consideration and hence Hd. ex-parte right now.

             This is the case of the complainant that he owns a Truck bearing No.WB-33-B-4538 which in course of time got repaired at the cost of Rs.4,12,548/-(Four Lakhs twelve thousand five hundred eighty four) only and the Insurance Company on that account pays Rs.1,39,804/-(One Lakh thirty nine eight hundred four) only pending the balance thereof and as such the case has come before this Forum with a prayer for securing compensation to the extent of Rs.2,72,780/-(Two lakhs seventy two thousand seven hundred eighty) only.

               Upon careful scrutiny of the record it is found that the entire amount of expenditure on account of repairing of the truck is supported by relevant document along with investigation report dated 18/08/2012 which exposes details assessment.

                Under the given facts and circumstances this is a fit case for granting relief as prayed for in terms of the prayer made in the petition of complaint.

               Hence,

                           Ordered,

                                           that the complaint case be and the same is allowed ex-parte.

                The Op-Manager, Reliance General Insurance Company Ltd. is hereby directed to make payment of compensation of Rs.2,72,780/-(Two lakhs seventy two thousand seven hundred eighty) only in favour of the complainant Motibul Mallick within sixty days in default the complainant is at liberty to proceed with the matter before the Forum in accordance with the provision of law.
