The Complainant has filed the present complaint under Section 35 of the Consumer Protection Act, 2019 against the Opposite Parties i.e. The Manager, HDFC Bank (Opposite Party No.1) and Sh. Sunder Singh, Police Station Dilshad Garden (Opposite Party No. 2). As per the complaint, Complainant is customer of Opposite Party No.1 having account no. 16671000022949 and customer ID. 3187636. On 19.06.23. Complainant present cheque having no. 000066 for withdrawal of Rs. 28,000/- but the same was not incahsed and cheque was returned with remarks “account number is freezed due to legal order”and told that Cyber Crime Police Bankura, West Bangal, Memo No. 2259/23, , Cyber Crime, P.S. Bankura, enquiry police officer Mr.SabyasachiChakraborty was freezed the account of Complainant. On 14.06.23 one unknown person transferred Rs. 19,000/- to his account through UPI and Complainant paid money in cash to customer. The Complainant stated that Cyber Crime Police Bankura, West Bengalregistered false complaint against him and freezed his account without intimation to him. The Complainant after receiving memorandum sent complaint to Cyber Police Station concerned and also online regarding the deficiency of bank manager and Cyber Crime Police Bankura, West Bengal but no action has been taken in favour of the Complainant. The Complainant registered online complaint bearing no. 28585722 on 20.06.23 on date reflected as 22.06.23 which is deficiency on part of HDFC bank. The Complainant also lodged complaint at Police Station Dilshad Garden on 19.06.23 and also visited regularly HC/ Opposite Party No.2 in respect of his complaint but all in vain.
In this context, we are guided the law laid down by the Hon’ble Supreme Court of India in the case of The Chairman & Managing Director, City Union Bank Ltd. &Anr. vs. R. Chandramohan reported in 2023 Live Law (SC) 251. The relevant portion of the said judgment is as under:
In view of the above, since this case involves highly disputed questions of facts as the account is freezed by police itself. The present complaint is dismissed.
Order announced on 07.07.23.
