Not satisfied with the order of the District Forum, the complainant preferred the above appeal urging that the District Forum erred in allowing the complaint, only to the extent of Rs.51,661/-

The complainant claimed that a total sum of Rs.88,000/- including the dividends           failed to prove that a total sum of Rs.88,000/- was paid by the subscriber, toward 44 monthly instalments as per the terms and conditions of the chit agreement. 

 

In the written version itself the opposite party has categorically admitted that the deceased subscriber paid  

 

             

 

        

 

       

 

 

In the result, appeal is allowed in part . The respondent/opp.party is directed to pay a sum of Rs.76,000/- less 5% towards foreman’s commission with interest at 9% p.a. from the date of the claim i.e. 26.4.2005
