JUDGMENT
The facts of the complaint in brief is that the complainant is a bonafied customer of Reliance Telecommunications and on 30.10.2015 to avail internet facility the complainant has recharged Rs.358/- for 30 days uninterrupted internet facility with 03GB data. The complainant used his mobile up to 28.11.2015 and in the morning of 29.11.2015 the complainant noticed that his internet facility is not available but in the evening hours of the same day again the mobile seta shows internet facility is available. On the very next day i.e. on 30.11.2015 the complainant got one message that the internet facility is over and he has to recharge further to avail the same and at his utter surprise the complainant noticed that his mobiles shows only Rs.0.30 as main balance where as on 29.11.2015 night his balance amount was Rs.496/- along with 3.20MB. Thereafter, the complainant make a call to the customer care service of the opposite party and came to know that his net pack was valid up to midnight of 29.11.2015 and the customer has used the internet facility bey9ohjd that so the opposite party has deducted the amount from the main balance of the complainant. Hence, prayed to direct the opposite party to recharge the amount of Rs.496/- along with 3.20 MB data and also to pay Rs.5,000/- for mental agony and Rs.2,000/- for litigation expenses to the complainant. Hence, this complaint.
Being noticed by this forum neither the opposite party appeared nor file any written version as such the O.P was set exparte and since the Opp.Party was absent we did not feel it necessary to go into the merits of the case and believed the allegations of the complainant and hence, we passed the order and disposed of the matter with the following directions.
ORDER
The opposite parties are directed to recharge the main balance amount of Rs.496/- to the mobile number 09778238358 of the complainant within one month from the date of receipt of this order and pay Rs.1,000/- towards costs and compensation.
Pronounced in open forum today on this 20th day of July,2016 under the seal and signature of this forum.
