                                                            JUDGMENT

1.                     The facts of the complaint  in brief is that,  the complainant has purchased  one  Hair LCD  T.V   L-32C-300 DCIJ Sl. No. 01103-DZBDK 0143   from O.p. No.1  with a  consideration of Rs.19,500/- on 20.12.2012  vide Invoice No.1084 with a warranty card but  to the utter surprise the said set started the trouble and the matter was informed to the O.p No.1  and delivered the same to him   and lodged complaint with Op No.2 through their web site and finally his request was heard by the company and sent his service persons to inspect the set. It was checked by Sri Sisir Kumar Rout from Sital Enterprises on 03.06.2015 and made an estimate for Rs.9000/- to Rs.10,000/- for the said service  and thus put the  into financial loss and mental agony. At last the complainant   finding no other option approached this forum for relief  and prayed  to direct the O.Ps  to   refund the full amount taken by the O.p. NO.1 or to replace the same with a new and for the mental agony and financial loss she  he may  be awarded compensation  along with cost of litigation and  such other relief/reliefs as the forum think  fit and proper.

2.                     On being noticed, neither the O.ps appeared nor filed any written version as such they were set exparte and  in absence of any written version from the opposite party we proceeded  the matter exparte and  believed  the allegations of the complainant  and  hence, we passed the order and  dispose of the matter with the following directions.

 

                                                                              

                                                                        ORDER

 

                        The  opposite parties  are directed to  repair the  LCD TV set with fresh warranty without charging any extra amount to the complainant  and pay  compensation of Rs.1000/-  for mental agony undergone by the complainant and  within one month from the date of receipt of this order, failing which the O.Ps are liable to pay  interest  @  12%  p.a. on the above awarded amount till  the date of payment.

                        Pronounced in open forum today on this 17th day of March,2016 under the seal and signature of this forum.

                         A copy of this order as per the statutory requirements , be forwarded to the parties    free of charge.
