ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:

                                                                                        JUDGMENT

            Complainant suppressing the fact regarding surrendering the vehicle bearing No.OD-16-B-8091 in respect of loan A/c No.1300102417 has filed the consumer complaint and obtained interim order dtd.09.11.2023 but did not comply by depositing the amount as per our order dtd.09.11.2023. The vehicle in question has already been auctioned and sold on 30.9.2023 which the complainant has suppressed and counsel for complainant has also not taken any step after obtaining the interim order. Relationship between complainant and opposite parties is that of Debtor and Creditor and failed to pay the EMI as per agreement/contract. We found no deficiency in service on the part of opposite parties and the consumer complaint has become infructous and no cause of action survives. Hence the consumer complaint is dismissed. No cost.
