12-02-2015 -       Heard learned counsel for the appellant on limitation as well as on merit.

2.       On limitation it is submitted that due to the reasons mentioned in the petition, there was delay of about 30 days in filing this appeal.

 

3.       On merit it was submitted that the gearbox given for repairing has not been returned to the complainant/ appellant, as wrongly held by the learned District Forum.

 

4.       After considering entire matter, the learned Lower Forum interalia held that a photo copy of the receipt alleged to have been issued by the dealer (O.P.No.2 /R-2) was filed by the complainant which showed that the gearbox in question was received by him with full satisfaction on 5.3.2009 but the original receipt was concealed by him. It was further held that the gearbox was received back by the complainant after repair on 5.3.2009 with full satisfaction and therefore there was no deficiency in service on the part of the opposite parties/ Respondents.

 

5.       After hearing learned counsel for the appellant at length and considering the materials placed before us, we find no reason to interfere with the findings of learned District Forum. Accordingly even if the delay of about 30 days in filing this appeal is condoned, we find no merit in this appeal, which is accordingly dismissed.

 

 

         Issue free copy of this order to all concerned for information and needful.
