            This is a complaint filed under section 35 of the Consumer Protection Act 2019.

            2.  Facts of the case in brief:-  The Complainant had purchased shoes by online from the Opposite Party for Rs.3,128.12/-.  The payment was made by cash on delivery on 14.06.2023.   The Complainant had got a wrong item which was a used chappal instead of the shoes the Complainant had ordered.  Hence, a return request was made by the Complainant on 15.06.2023.  The Complainant had requested the Opposite Party to take back the shoes and refund the amount of Rs.3,128.12/-.  Hence, this complaint praying to give a direction to the Opposite Party to pay compensation of Rs.5 Lakhs.

            3. The Opposite Party had filed version. But, inspite of a number of postings and notices to the Complainant he failed to give evidence related to the case before the Commission.  No documents were marked by the Complainant nor he had adduced any oral evidence.  The Opposite Party had also not adduced any evidence.  Commission considered the case for disposal on merit.  But on scrutiny of the case, it was found that the Complainant has failed to prove his case and therefore we are of the view that there is no merit in the case of the Complainant and is liable to be dismissed.

            In the result, the complaint is dismissed without costs.
