This is a complaint presented u/sec. 12(c) of the Consumer Protection Act – 1986 by 22 persons of Indaragi village with a common relief as under;

1. Policy amount for 22 complainants            -           Rs.   15,400=00
2. Compensation for 22 complainants            -           Rs. 4,40,000=00
3. Expenses                                                             -           Rs.    20,000=00

TOTAL                      -           Rs. 4,75,400=00

            2.  As per the complaint, each one of the complainants have paid Rs.700/- each to the OP No.3 for payment to LIC but policy has not been issued to them.

            3.  Section 12 (C) of the Consumer Protection Act – 1986 permits filing of the complaint in relation to any service by one or more consumers where there are numerous consumers having the same interest on behalf of or benefit of all consumers so interested with the permission of the District Forum.

4.  In this case, there are 22 complainants.  Each one having different interest in respect of the service to be rendered, e.g., deficiency in service in respect of complainant No.5, Bhimappa Thimmappa Bogi, another complainant say, the complainant at Sl.No.20, Subhash Dinesh Vimmi could not have any kind of interest.  This is not a case where there are numerous consumers having the same interest.  Each one of the complainant having different interest.  Therefore they should have filed separate complaints in respect of the cause of action if any pertains to them only.  Therefore this Forum declines to grant the permission u/sec. 12 (c) of the Consumer Protection Act – 1986.

5.  For the above reasons, the complaint is dismissed at the stage of admission.  The complainants are at liberty to file separate complaint.
