The complaint is filed under section 12 of the Consumer Protection Act against the opposite parties for refund of the course fee with interest and compensation.
2. Brief of the complaint:- On 26.07.2013 one of the representative of opposite parties approached complainant's house at Vythiri, Wayanad for taking admission in the opposite parties institution. He collected Rs.78,450/- towards tuition fee together with complainant's certificates. Thereafter she joined in opposite parties institution, after 8 days she discontinued the course. But opposite parties were not ready to refund the collected tuition fee. Hence filed this complaint to refund the remitted course fee and donation with interest and compensation.
3. On being served the notice, opposite parties appeared and filed I.A.123/2015 to hear and decide the issue of maintainability of this complaint as a preliminary issue. Respondent/Complainant filed counter in I.A. 123/2015 stating that the allegation stated in the petition is false and concocted and the complaint is maintainable before this Forum. On going through the petition and submissions by both parties we finds that opposite party's institution situated at Calicut District and there is no branch office or agent within the jurisdiction of this Forum.
4. Hence the Forum finds that this Forum have no territorial jurisdiction to entertain this complaint, hence the I.A. 123/2015 is allowed and complainant is directed to file the complaint before proper Forum.
Since the I.A.123/2015 is allowed, the complaint is also dismissed.
