Today is fixed for hearing of the RA Application dated 19/04/2021.  Petitioner side is present.  Op side is also present.  Ld. Advocates of both sides are ready.  Heard both sides.  Considered submissions. 

Perused the RA Application and w/o filed by the respondent side.  On close examination of the matters of the case record it appears that this RA Application has been filed for recalling of the ex parte hearing which was fixed in case no. C.C. 88/2020.

On the background of the above noted position the District Commission on close examination of the materials of C.C. No. 88/2020 finds that the Op has filed w/v which has been kept with the record.  Moreover for the interest of proper and complete adjudication of this case there is necessity of accepting the said w/v.

Thus, the RA Application of 01/2021 is allowed on contest but at the cost of Rs. 1000/- payable to the respondent side.
