ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:

                                                                                                    JUDGMENT

            Complainant owner of multiple vehicles has filed two cases before this Commission seeking a direction not to repossess the vehicle and settle the loan account. During pendency of consumer complaint the vehicle in respect of C.C. No.407/2022 has already been repossessed and process has been started to sale/auction the vehicle in which we don’t interfere and C.C. No.407/2022 is dismissed.

            Taking a linent view we direct that in case of C.C. No.406/2022 if complainant pays 30% of pending dues and pays rest amount in 05 EMIs then no coercive action may be taken against vehicle No.OD-29-D-8425. On failure to pay 30% within 15 days from the date of receipt of order, or 30 days after passing of order whichever is better, the opposite parties are free to take action as per the agreement and same condition also applies for rest 05 EMIs of the balance 70% of pending dues. With the aforesaid observation and direction C.C. No.407/2022 is dismissed and C.C. No.406/2022 is disposed of. No cost.
