Heard the Ld. Advocate for the complainant and perused the documents filed with complaint petition. From annexure A – 1, it appears that total finance amount 6,50,000/-, loan date 24/02/2013. First EMI due on 07/04/2013, 2^nd EMI due on 07/05/2013.

Loan period is 48 months. No document has been furnished by the complainant wherefrom it reveals that complaint has been paying EMI s regularly, month by month.

So, we are of the view that the complainant is reluctant to deposit EMI in a regular manner, hence it can no be concluded that o.p. is liable for deficiency in service.

In view of the above observation the the instant complaint petition is rejected and under such condition the petition U/S 13 [ 3B ] deserves no consideration.
