ORDER

By SRI.K. VIJAYAKUMARAN, PRESIDENT Complaint filed by the complainant for getting compensation and other reliefs. The averments in the complaint can be briefly summarized as follows: The complainant bought a new Maruti Alto LXI model car from the 1st opp.party on 21.10.2005. The 1st opp.party is the dealer of Maruti Udyog Ltd and 2nd opp.party is the manufacturer. On the date of purchase itself the complainant applied for extended warranty for extra 2 year period to be commenced after normal warranty period gets expired, by paying Rs.1360/- as additional service charges. But the 1st opp.party after collecting the amount did not issue the extended warranty booklet as promised. The complainant approached the 1st opp.party so many times to get the extended warranty booklet but the same was not issued. This is deficiency in services and unfair trade practice. Hence the complaint. Opp.party 3 was impleaded as per order in I.A. No.21/2008 dated 22.4.2008 The opp.parties were duly served but they remained absent and hence they were set exparte. Thereafter the complainant filed affidavit andExt.P1 to P3 were marked. From the un impeached testimony of PW.1 and Exts. P1 to P3 we find that there is deficiency in service on the part of the opp.parties. In the result the complaint is allowed directing the opp.parties to give extended warranty booklet to the complainant for extra 2 year period and also directed to pay compensation of Rs.7,500/- and cost Rs.500/- to the complainant. The order is to be complied with within one month from the date of this order. Dated this the 30th day of May, 2008. I n d e x List of documents for the complainant P1. – Cash receipt dt.21.10.2005 P2. – Advocate notice dated 25.6.2007 P3. – Post receipt dated 25.6.2007
