Complaint Case No. 24/2023

Seen the joint compromise petition No. 311/24 filed Under Order 23 Rule 3 of CPC 1908 as amended upto date by the Complainant Liton Dey and the engaged advocate for the opposite party No. 1 and 2 stating that on 27.08.2024 the claim petition has been fixed for hearing on petition No. 299/24. It is stated in the petition that the case has already been amicably settled between the complainant and the opposite party No. 1 and 2, i.e. IFFCO TOKIO General Insurance Company Ltd. and the opposite party No. 1 and 2 have agreed to pay the complainant an amount of Rs. 3,90,000/- (Rupees Three Lakhs Ninety Thousand) only for the theft of the vehicle of the complainant which occured on 18.11.2021. It is further stated in the petition to accept the compromise petition and dispose of the case with a direction to the opposite party No. 1 and 2, i.e. IFFCO TOKIO General Insurance Company Ltd. to pay the said amount of Rs. 3,90,000/- (Rupees Three Lakhs Ninety Thousand) only within 1 (One) month from the date of order to the Complainant. It is also prayed that the case be disposed of on compromise.

Both the parties are present through their learned counsels. Heard the learned counsels for both the sides. Also perused the case record.

Compromise petition is Allowed. The compromise petition shall be a part of this order.

The opposite party No. 1 and 2 are directed to pay an amount of Rs. 3,90,000/- (Rupees Three Lakhs Ninety Thousand) only within 1 (One) month from today in favour of the complainant as full and final compensation.

The case is disposed of on compromise accordingly.
