                                                JUDGEMENT.

The  crux of the case is that  the above named complainant alleging deficiency in service  against  afore mentioned O.Ps    for  non  rectification of  38SRC 1 Rotisserie- 38 Litres Machine Sl. No. 5000742 during the AMC period  for which  the complainant  sought for redressal of the grievances raised by the complainant.

The Back ground  facts in a nutshell  are that    the complainant had purchased  a 38SRC 1 Rotisserie- 38 Litres Machine Sl. No. 5000742 through  on line     from the IFB company on Dt.16.09.2014   on  payment  of amount a sum of Rs.14,590/-. The O.Ps. have   sold  the  said set to the complainant providing  two  year warranty period  vide Order No. 100018647. After expiry of warranty period the complainant  made A.M.C. to the above  product on Dt.30.4.2016 which is valid till  29.4.2018  bearing ICR No. 181617000376  on payment of consideration amount a sum  of Rs. 3,320.00. During the A.M.C period the complainant has  informed the O.Ps that  the above product  is not functioning but the O.P paid deaf ear and not heard any thing. The complainant approached from pillar to post to solve the above problems but  not rectified the problems of the above product  by the O.Ps. inspite of repeated  complain  bearing complain Dt. 13.9.2017 and Ticket No. 1000427807.  Now the above set is unused.  But  no  action has been taken by the O.Ps till date. Hence this case.          The  complainant prays the forum direct   the O.Ps to  replace the same with a new one with fresh warrantee  and  grant such other relief  as the hon’ble forum deems fit and proper under circumstances of the case  for the best interest of justice.

On being noticed  the O.Ps  neither   entering in to appear before the forum nor filed their  written version inspite of more than  15 adjournments has been given  to them. Complainant consequently filed his memo and prayer to set exparte of the O.Ps.  Observing lapses of around 1(One) years   for which the objectives  of the legislature of the C.P. Act going to be destroyed to the prejudice of the interest of the complainant.  Hence after hearing  the  counsel for the complainant set the case  exparte against the O.Ps. The action of the O.Ps are against the principles of  natural justice as envisaged  under section  13(2) (b)(ii) of the Act. Hence the O.Ps.  were set exparte  as the statutory period  for filing of  written version was over to close the case with in the time frame permitted by the C.P. Act.

          We therefore constrained to  proceed to dispose of the case, on its merit. 

          Heard from the complainant.   We perused the complaint petition and the document filed by the complainant.

 

 

         FINDINGS.

                Undisputedly the complainant had purchased  a 38SRC 1 Rotisserie- 38 Litres Machine Sl. No. 5000742 through  on line     from the IFB company on Dt.16.09.2014   on  payment  of amount a sum of Rs.14,590/-. The O.Ps. have   sold  the  said set to the complainant providing  two  year warranty period  vide Order No. 100018647(copies of the order copy and payment of consideration is in the file which is marked as Annexure-I). After expiry of warranty period the complainant  made A.M.C. to the above  product on Dt.30.4.2016 which is valid till  29.4.2018  bearing ICR No. 181617000376  on payment of consideration amount a sum  of Rs. 3,320.00(copies of the  Invoice-cum-receipt and  AMC contract   are in the file which is marked as Annexure-2 & Annexure-3).

            The main grievance of the complainant is that during AMC period the above product found defect but the O.Ps were could not be rectified  inspite of repeated contact  with the O.Ps.  Hence this C.C. case.

It further appears that prior to filing   of complaint, the complainant had made complaint to the O.Ps on Dt.13.9.2017  vide  ticket No.1000427807 through  on line, but they failed to furnish  any  reply to the said   letter.  Hence it appears that the O.Ps  have been negligent and callous regarding the complaint of the complainant. So the complainant filed this C.C. case before the forum.

During  the course of hearing the complainant appeared before the forum in person  and submitted  that  after receipt of the notice from the forum the O.Ps have  rectified the same, but the complainant  wants to extend  the AMC period  till   29.4.2020 without  charging  any  amount to the complainant.

Heard. Perused the memo filed by the  complainant. The memo is allowed.

 

 

This forum observed after filing of the C.C. case the O.Ps  have rectified  promptly  the above product.  But the  complainant filed a  memo submitted that  to extend  the AMC period  till   29.4.2020 without  charging  any  amount to avoid further  complain.

To meet the ends of justice the following order is passed.

                                                ORDER.

The  O.Ps are directed    to extend  the AMC period  till   29.4.2020  to the product  38SRC 1 Rotisserie- 38 Litres Machine Sl. No. 5000742 without  charging  any  amount  to the complainant  to avoid further  complain.

parties are left to bear their own cost.  Accordingly the case  is  disposed of.

            Copies be  served on the parties as  per  rule.

No. 5000742 without  charging  any  amount  to the complainant  to avoid further  complain in future  for the best interet  of justice.
