Present:          Sh.Muni Lal Sharma, Complainant in person.

                        Sh.Himendra Pal Singh, Legal Manager of OP No.1 & 2 alongwith counsel Sh.Sandeep Suri, Advocate.

Dated, the 13^th day of January, 2011.

                                                            ORDER

1.                     The parties appeared and OP No.1 & 2 has made offer as per the statement given below:

“Statement of Sh.Himendra Pal Singh, Legal Manager of OP No.1 & 2 alongwith counsel Sh.Sandeep Suri, Advocate.

The draft of Rs.61,605/- has already been deposited with this Forum for disbursing it to the complainant. The bank is ready to close the loan for an amount of Rs.74,000/- in case the same is paid by the complainant within a period of 7 days from today i.e. 13.1.2011 and the NOC will be issued to the complainant within 30 days thereafter. The statement of account has been given to the complainant”  

2.                     The complainant has accepted the offer as per the following statement:-

“Statement of Sh.Muni Lal Sharma s/o Late Sh.R.D.Sharma, Complainant in person.

I have gone through the statement given by Sh.Himendra Pal Singh, Legal Manager of OP No.1 & 2 alongwith counsel Sh.Sandeep Suri, Advocate and accepted it as correct. I have received draft of Rs.61,605/- dated 27.12.2010 in my name. I withdraw the present execution application”

3.                     The respective parties shall remain bound by their statements.

4.                     Keeping in view the above, since the complainant has withdrawn the present execution application, the same is dismissed as withdrawn.

5.                     Copies of this order free of cost be supplied to the parties. The file be consigned.
