Order No.14, dated 09/12/2013.

           The Complainant is present personally & filed a petition through the Ld. Agent for permission to withdraw the complaint O.P. No.1 files against hazira.

           None appeared on behalf of the O.P. No.2 so the proceeding runs ex-parte against the O.P. No.2 i.e. the Branch Manager, HDFC Bank, Cooch Behar Branch, whose name has been incorporated in accordance with the prayer of O.P. No.1 for proper adjudication of the complaint.

             Today is fixed for filing evidence on affidavit by the O.P. No.1.

            The Complainant files a verified petition to withdraw the complaint as the dispute in question that cropped up between the parties has settled amicably and the prohibitory order has been withdrawn by the O.P, so the Complainant is operating the bank account freely and he has no impediment to transact the account lying before the O.P Bank.

         As such this Complainant likes to withdraw the complaint without any compensation and the agent of the O.P. No.1 put no objection for withdrawing the complaint.

          After perusing the documents and complaint in question, we are in a considered opinion to accept the verified petition as filed by the Complainant and the Complainant is allowed to withdraw the complaint as it is useless to continue the proceeding further more because the dispute has been settled amicably with the verbal discussion between the parties and the Complainant is no way interested to continue the same.

Hence,

           Ordered,

                        That the complaint be and the same is disposed of being withdrawn without any cost.
