Final Order / Judgement

The  brief  facts  of the case  are that  the complainant purchased a vehicle called Tuk-tuki  from the respondent/  Opposite Party  i.e, the Manager Hindustan Electrical vide Registration No -AS11-KR-1088,  Model  G-7, color-  Red & Black  by  paying Rs. 1,60,995.00  (  Rupees  one Lakh Sixty Thousand Nine Hundred  & Ninety Five) only through Union Bank Finance .  As the said vehicle started giving  disturbance  so the  complainant handed over the vehicle  from  26-12-2018 to 15-01-2019  to the  O.P.  for repairing .   Again from 23-04-2019 to 30-04-2019  and   03/05/2019  to  04/05/2019   the  complainant handed over the vehicle for repair but the service  of the  O.P.  was not satisfactory  to run the vehicle.  In the warranty and manual card it is mentioned that the vehicle must run 80 K.M. per day after one time battery charge but the vehicle runs only 25/30 K.M.  after full charge.  Sometimes  when 4(Four) passengers are carried the vehicle’s battery becomes down & can not run. Again the vehicle was under repair from 03-06-2019 to 28-06-2019 but repairing  was  not satisfactory and complainant suffered  a  lot.  Thus  due to  continuous problems  in the tuktuki  the complainant  could not  drive the vehicle  and also  could not  earn  and  pay the monthly installment of  the  Bank. That  there   is  manufacturing defect  of the vehicle for which it can not run properly and smoothly.   Under the circumstances  the  O.Ps.   are  liable  to change the vehicle  and also  they are liable to pay compensation  for the loss of income of the complainant.  In his evidence  on affidavit  the complainant  has also  corroborated  the same facts  that he purchased  the alleged  ‘TUKTUKI’  and  immediately after  purchase it started giving  continuous  problem.  Though the vehicle was  handed over to the  O.Ps.  several times but their service  in respect of the vehicle was not satisfactory  and the  problems of the vehicle were not solved.  And as a result the  complainant could not run the vehicle  properly and smoothly.  The complainant  has further alleged that the  O.P.  forcibly took his signature in a  printed written undertaking  that  repairing was  done satisfactorily.  The complainant has also exhibited  necessary papers  to substantiate his claim.  The  complainant  side  was also heard.  On the other hand  notice was issued to the   O.Ps.  but  they  refrained  from  contesting the case.

                                             After  going through the materials on record  we  hereby direct  the  Opposite  Parties  either to  give a new TUKTUKI  of the same model &  quality to the complainant  in exchange of the present one   or  the  O.Ps.  shall  refund the entire purchase amount  i.e.,  Rs. 1,60,995/- (Rupees one lakh sixty thousand nine hundred ninety five)  only to  the complainant.     The  O.Ps..  are  further  directed to pay to the complainant  an amount of Rs. 1,00,000/-  ( Rupees  One lakh) only  as compensation  for loss of income  and  an amount of Rs. 10,000/-  ( Rupees ten thousand)  for mental agony, pain  &  harassment.  In addition, the  O.Ps.  shall also pay  further amount of Rs.10,000/-  (  Rupees ten thousand ) only  towards cost of litigation.  It is further ordered that the entire amount shall be payable within a period of  next  60(sixty) days  else  interest @ 10% per annum would  accrue  on the entire amount from the date of  this order  till realisation of the amount.  However,  if  new vehicle  is not given  in exchange  then the  complainant  shall be liable to return  his present one  after receipt of the entire amount as ordered.

                                         The case stands disposed of  in exparte against the  O.Ps.  Send a  copy of the order to the address of the O.Ps.  for compliance.
