            The complainant filed a petition praying for restraining the O.Ps and their hence men and agents from dispossessing the complainant from the scheduled property and from changing the nature and character of the said property interalia till disposal of this case stating the ground therein. This petition is registered as M.A. being No. 86/2020. The instant case is moved by the Ld. Advocate appearing for the complainant. Heard him. Perused the petition, the complaint and the relevant documents. On perusal of the aforesaid materials it is revealed to us that the prima facie case is made out. But we found no urgency as well as cause of irreparable loss of the scheduled property. Rather if the instant case be allowed in that event the trial of this case surely be delayed since the instant case (CC - 38/2020) stands on summary procedure.

 

          Hence, the instant M.A. being No. 86/2020 is dismissed.

 

          To date (20.01.2021).
