Final Order / Judgement

 

 

      One Sri.Kishore Hegde, who is representing OPs 1 & 2 files a memo together with two documents including original letter submitted by Ms.Nidhi Shree.J.  The learned advocate for complainant submits notarised copy of family tree as well as attested copy of family tree.

 

      The complainant has already cleared all the overdues and the OP Bank has no claim what so ever including loan account held by her deceased husband.  On the last date the OPs produced all the original documents submitted to them by the deceased husband of complainant while obtaining loan.  Now, the only request of the complainant is for return of original documents and they have given up other prayers made in the complaint.

 

      According to the family tree produced by the complainant, the deceased Mr.J.Shridhar Bhat has left behind him his wife Smt.U.Paniamma, his son Mr.Kiran Thirumalesh.J (complainants) and a daughter Ms.Nidhi Shree.J, who is major.   Other than these three the deceased Mr.J.Shridhara Bhat has not left any other legal heirs. The daughter Ms.Nidhi Shree.J has already submitted a letter to the Bank on 08.04.2016 requesting them to hand over the original documents in the hands of her mother Smt.U.Paniamma and brother Mr.Kiran Thirumalesh.J.  In view of the letter submitted by Ms.Nidhi Shree.J there is no impediment to hand over all the original documents in the hands of the complainant.  Therefore, we are of the opinion that the original documents which were submitted to the court by the OPs on 05.07.2016 with a list shall be handed over to the complainants.  The said original documents includes two original sale deeds, a sanction plan dated 01.03.1980, Endorsement dated 13.09.2000, Khatha Certificate dated 07.08.2007, Tax paid receipt dated 31.05.2007, three EC from 01.06.1989 to 09.07.2007, tax paid receipt dated 17.08.2016, EC from 01.04.2007 to 17.08.2010 and a letter from Canara Bank dated 06.08.2007 all original.  The office is directed to hand over the above mentioned 12 original documents to the complainant with proper acknowledgement.

 

      The learned advocate for the complainants submits that the complainants have no other claim against the OPs and prays for disposing of the complaint.   In view of the submission made the complaint is disposed off as settled amicably.
