ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:

                                                                                     JUDGMENT

            Complainant has filed the consumer complaint U/s.35 of C.P. Act, 2019 seeking a direction for issuance of NOC in respect of vehicle bearing Regd. No.OD-02-AM-3431, Chassis No.MEXB17609HT122007, Engine No.CWX158704 vide loan account No.49079353 and UCIC-74239247 and cost of Rs.4,50,000/- towards loss sustained by complainant, mental agony and cost of litigation.

            Notice to opposite parties was sent by Regd. Post on 23.9.2022 but the opposite parties did not respond and did not appear before this Commission for which the opposite parties were set ex-parte on 26.7.2023.

            Since the opposite parties have not responded to the notice of this Commission and filed statement where in complainant shown to have paid the EMIs and very few amount shown as pending and the opposite parties failed to justify as to how complainant is not entitled to get NOC and due to pay few thousand rupees out of loan amount of Rs.5,76,000/- towards purchase of Motor Car (Ameo 1.5), we accept the version of complainant and without awarding any cost and compensation direct the opposite parties to adjust the entire loan treating as direction of this Commission to pay the same amount as cost, compensation towards loss and mental agony and treat the loan as zero and issue NOC to complainant within 30 days from the date of receipt of this order as the opposite parties did not appear and filed any written version and disregard to the notice of this Commission. With the aforesaid observation and direction the consumer complaint is disposed of. No cost. 

            Pronounced in the open Commission on this 25th October,2024.
