                                                                                                 JUDGMENT

            Complainant has filed consumer complaint seeking refund of Rs.7,70,000/- deposited on 25.11.2022 in the account of opposite parties to purchase the auction vehicle TATA truck (LPK 2618 TC) of the Mfc year 2016 in pursuance of auction of opposite parties. The vehicle was to be delivered by 30.11.2022. On 01.12.2022 when complainant inspected the vehicle he found that the chassis number is not legible and engine number is punched. So he refused to take the vehicle and demanded to opposite parties to return the deposited auction price of Rs.7,70,000/- and being unsuccessful approached this Commission. On 07.6.2023 notice to opposite parties were issued on 13.6.2023 by Regd. Post with AD but no response from opposite parties for which we set the opposite parties ex-parte on 04.8.2023.

            Selling a vehicle without proper engine and chassis number amounts to unfair trade practice and also fraud for which complainant has every right to ask to return the amount deposited with opposite parties and non refund of the deposited amount by the opposite parties amounts to deficiency in service for which we direct the opposite parties to return the deposited amount of Rs.7,70,000/- with 10% interest from the date of deposit till date of refund and we also award cost of Rs.20,000/- towards deficiency on service, unfair trade practice and also impose cost of Rs.5,000/- towards cost of litigation. With the aforesaid observation and direction the consumer complaint is disposed of.
