In fact an earlier notice was issued to opposite party on 30-9-2006 which was also served on opposite party. Due to the vacancy in the post of the President there was no Sitting of the Forum then and after Sitting commenced a further notice was issued. So opposite party had the priveledge of service of notice two times. Even then opposite party has opted to remain absent. Complainant filed affidavit on 20-11-2007. Exts.A1 to A11 marked. Claim proved. Opposite party is ordered to issue clearance certificate to the complainant in respect of vehicle No.KL-10R-3033 within three weeks from the date of receipt ofcopy of this order failing which on request made by the complainant copyof this order will be communicated to the concerned Regional Transport Officer who on receiptof copy of this order shall cancel the endorsement in respect of vehicle No.KL-10R-3033 in favour ofopposite party.
