The petition of complaint has been filed by the complainant Nikhil Chandra Karmakar against the o.ps. GE Money Financial Services Pvt. Ltd. The case of the complainant in short is that complainant took loan from o.ps. of Rs.14,550/-, Rs.5314/-, Rs.32,500/-, Rs.1,21,475/- and the o.ps. gave Rs.19,864/- for the aforesaid 1st loan and 2nd loan together and complainant returned Rs.45,819/- within 3 years i.e. on 18.6.07 and within such short period no loan could be increased in 2.5 times of the capital amount and the said recovery was illegal as agitated by complainant. specific case of the complainant is that his 4th loan amount was Rs.1,21,475/- and complainant returned Rs.29,334/- on 23.8.08 and after that o.ps. started claiming huge amount to settle the rest part of loan amount as mentioned above. Further case of the complainant is that o.ps. are pressing hard for settlement after making payment of huge amount by complainant. Hence the case.
O.ps. did not contest this case by filing w/v and matter was heard ex parte against them.
Decision with reasons:-
We have gone through the pleadings of the parties, evidence and documents in particular and we find that there appear some lapses on the part of o.ps. being service provider to its consumer / complainant and complainant is entitled to relief since the evidence filed by complainant has remained unchallenged testimony and o.ps. did not put forward to rebut the same.
Hence, ordered,
That the petition of complaint is allowed ex parte in part against the o.ps. O.ps. are jointly and/or severally directed to supply the copies of documents as per agreement and statement of account to the complainant and are further directed to pay to the complainant compensation of Rs.5000/- (Rupees five thousand) only for his harassment and mental agony and litigation cost of Rs.2000/- (Rupees two thousand) only within 45 days from the date of communication of this order, i.d. an interest @ 9% shall accrue over the entire sum due to the credit of the complainant till full realization.
Supply certified copy of this order to the parties free of cost.
