23 | 20.02.24 | Today is fixed for filing evidence by the Complainant but the Complainant is found absent on call. The record shows that the Complainant was found absent on call on 17.06.20, 24.07.20, 06.10.20, 28.12.20, 23.03.21, 29.06.21, 08.12.21, 25.02.22, 13.05.22, 12.08.22, 06.12.22, 16.03.23, 12.06.23, 21.08.23, 09.11.23 and today i.e. on 20.02.24. The Complainant Tushar Chatterjee filed the instant complaint praying for necessary direction to the OP to pay Rs. 60,000/- for goods value + Courier service charged of Rs. 3,141/- + mental pain Rs. 2,00,000/- + Harassment cost with 10% interest. But the Complainant has not been filing evidence for long period. The Complainant has also been being absent for long period. Such being the position, we are of the view that the instant case has no merit and as such the Complainant is not at all interested in the instant case. The instant case is liable to be dismissed. Hence, it is Ordered that the complaint Case No. CC/136/19 be and the same is dismissed on merit against the OPs. Let plain copy of this order be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand /by post under proper acknowledgment as per rules, for information and necessary action.
